You’ve probably been seeing CBD all over the place…in the news, on the billboards, in social media…you name it, it’s there! But as with any emerging trend, questions arise regarding its legality.

Sometimes, it’s hard to sort fact from fiction, so let’s explore the legal landscape of CBD, its status in North Carolina (our home base, hi!), its international legality, and your responsibility as a consumer.

CBD’s Legal Status in the United States

The legality of CBD in the United States is a nuanced topic. The 2018 Farm Bill marked a significant milestone by legalizing hemp-derived CBD at the federal level (see source here). 

However, the bill mentions that CBD products must contain LESS than 0.3% THC (tetrahydrocannabinol) to be considered legal – rest assured that our product meets this legal compliance. And just in case you weren’t aware, a certain level of THC is what induces that “high”, not CBD.

Thanks to the Farm Bill legislation, a wave of new CBD products started to show up in the market, ranging from tinctures and capsules to gummies and topical products. Naturally the growth of new CBD companies also means that individuals are able to safely explore CBD’s potential benefits.

While the Farm Bill legalized hemp-derived CBD at the federal level, CBD’s legal status can still vary from state to state within the US. 

For instance, some states chose to align their laws with federal regulations, while others have imposed stricter regulations or even outright bans on certain CBD products. We have summarized the information as follows:

CBD in North Carolina: Our Home Base

North Carolina is well and truly flourishing as a state with a large amount of CBD-based companies. Hemp-derived CBD is legal in the state, aligning with federal regulations, and our products have also been carefully crafted from organic hemp sourced from North Carolina, which adheres to both state and federal guidelines.

However, it’s important to be aware of your local regulations even within a CBD-friendly state. Always exercise due diligence and stay informed about any updates or changes to the laws.

International CBD Legality: A Global Perspective

The legality of CBD varies widely across the globe, reflecting diverse cultural attitudes and regulatory frameworks, so the laws are not completely black and white.

But here are some countries that have welcomed the use of CBD with open arms. For instance:

Canada: Canada legalized both CBD and THC for recreational use, making it one of the most progressive nations in terms of cannabis legislation.

  • United Kingdom: In the UK, CBD products with a THC content of less than 0.2% are legal, and are sold as supplements rather than medicine.
  • European Union: Many countries within the EU have decriminalized or legalized CBD, though regulations may vary from country to country.
  • Australia: CBD is available for purchase with a prescription, allowing consumers to access its potential benefits under medical supervision.
  • Japan: CBD products with zero THC content are legal in Japan.

Not all countries have welcomed CBD in the same way. Some nations maintain stricter regulations or have outright bans on CBD products. For example:

  • Singapore: CBD is considered a controlled substance in Singapore, and its possession or use is strictly prohibited.
  • Russia: CBD is not allowed for use or sale in Russia, and there are severe penalties for violating these regulations.

CBD Legality in the US: State by State

Within the United States, CBD’s legal status varies significantly from state to state. While hemp-derived CBD with less than 0.3% THC is legal at the federal level, some states have more stringent regulations. 

Of course, the legal landscape is continuously evolving and we recommend that you stay updated on the latest regulations in your state. As of August 2023, the following states have incorporated stricter policies or bans on certain CBD products:

  • Idaho: Idaho has stringent regulations on CBD, and it’s illegal to possess or use CBD products that contain any amount of THC.
  • South Dakota: Both hemp-derived and marijuana-derived CBD are illegal in South Dakota.
  • Nebraska: CBD is not fully legalized in Nebraska, and its legality remains a subject of debate.
  • Kansas: The state has restrictions on CBD with varying levels of THC, making it essential to be cautious.
  • Mississippi: CBD is only legal for patients with epilepsy under the state’s restrictive medical marijuana program.
